â–ş Presentation of the book: while the power of the administration is recognised and strongly framed by Law, private powers, and first of all economic power, which is present in all relations between private persons, are much less so. Law grasps them through the contract of adhesion, contractual imbalance or the opposition between the weak party and the strong party, without making power a genuine legal notion with its own regime.
The collective book first examines the forms taken by economic power (concentrations, new forms of subordination, cascades of legal persons, algorithmic power), then the responses that the various branches of Law can provide: fundamental rights, Competition Law, Labour Law, Civil Liability Law. To this end, it brings together the perspectives of private and public lawyers, economists and philosophers.
With contributions by Muriel Fabre-Magnan, Franck Fischbach, Justine Lacroix, Pascal Lokiec, Jean-Philippe Robé, Jean-Christophe Roda, Alain Supiot, Guillaume Vuillemey and Célia Zolynski.
