â–ş English Summary of this article (article written in French, English summary by the Journal of Regulation & Compliance – JoRC): AML/CFT Compliance is one of the most accomplished forms of Compliance Law. The author shows that its reception by the banking sector brings about a twofold shift: normative, as the obligation of vigilance becomes a continuous requirement to justify the measures implemented; functional, as institutions are mobilised in the service of a general-interest goal without having all the corresponding legal means. Two symmetrical drifts result, compliance washing and de-risking, showing that Compliance driven solely by fear of sanctions may produce conformity without effectiveness or caution without surveillance. Ethics then appears as the condition for the model’s balance.
