â–ş English Summary of this article (article written in French, English summary by the Journal of Regulation & Compliance – JoRC): Despite its strong intuitu personae, the credit agreement does not escape the AML/CFT Compliance Obligation. The author shows that it now permeates the pre-contractual phase (risk analysis distinct from creditworthiness assessment, know-your-customer, choice of distribution channels and intermediaries), the management of the relationship over time and the very content of contracts (KYC clauses, representations and undertakings, rights of suspension or termination, asset freezing). She analyses its effects both in relations with customers and in relations with the institutions’ partners and intermediaries.
