Supervision. Compliance. Three terms that until recently were virtually unknown in legal systems. Or at least considered to be peculiar to Anglo-American legal systems: Regulation, Supervision, Compliance. These terms are like Trojan horses through which Common Law is taking over our legal traditions to make European companies, especially banks, bend over backwards, take over institutions and impose methods. Three words by which the invasion is carried out. Through the violence of repression and compliance penalties, through the mildness of codes of conduct and corporate social responsibility. By laws as new as they are strange, such as the French so-called “Sapin 2” law or the French law introducing a “duty of vigilance” for companies whose fault would be to have succeeded in expanding internationally. One can have this defensive conception of Compliance, generating a “Compliance Law”, produced by the internalisation of Regulatory Law in global economic operators, who are then subject to supervision by Regulators, even though these firms are not regulated, with Compliance extending beyond the supervised sectors (banks and insurance companies). We can (and maybe must) have a more welcoming, and therefore more offensive, conception of Compliance. It can be the crucible of a relationship of trust on a supra-national scale between these operators and the regulators, the former being able to contribute, like the latter, to serving goals that go beyond them all, of which the fight against corruption and money laundering are but a few examples. ► Full Reference: Frison-Roche, M.-A., Globalization from the point of view of Law, working paper, May 2017. - 🎤 This working paper initially served as a basis for a synthesis report made in French in the colloquium organized by the Association Henri Capitant in the International German Days on the subject of "Le Droit et la Mondialisation" (Law and Globalization). 📝 Il sert dans un second temps de base à l'article paru dans l'ouvrage La Mondialisation. 📝 it serves as a second basis for the article (written in English, with a Spanish Summary) to be published in the Brezilian journal Rarb – Revista de Arbitragem e Mediação  (Revue d`Arbitrage et Médiation). It uses the Bilingual Dictionary of the Law of Regulation and Compliance. - ► Summary of the Working: Globalization is a confusing phenomenon for the jurist. The first thing to do is to take its measure. Once it has been taken, it is essential that we allow ourselves to think of something about it, even if we have to think about it. For example, on whether the phenomenon is new or not, which allows a second assessment of what is taking place. If, in so far as the law can and must "pretend" to defend every being, a universal claim destined to face the global field of forces, the following question – but secondary – is formulated: quid facere? Nothing ? Next to nothing ? Or regulate? Or can we still claim that the Law fulfills its primary duty, which is to protect the weak, including the forces of globalization? - read the Working Paper below⤵️

The promethean nature of the future banking and financial regulatory law

This working paper was prepared as a basis for a contribution to a forthcoming volume of the collection Le rapport moral de l'Argent dans le Monde ( The Moral Report of Money in the World). It develops the idea that everyone has the impression that the law is more powerful than ever in banking and financial regulation: Law invades everything and appears in its most terrible form that is criminal and repressive administrative law. It seems that the beginning of everything is Law ! But in reality, we must consider that the law is weaker than ever. Indeed, if the law of banking and financial regulation has become primarily repressive, it is because it is weak. It took the form of a multitude of microscopic rules and  punishment is only lending its force to any prescription. Repression has lost its autonomy, and has become a sort of simple enforcement of civil multiple rules. Moreover, the legislation degenereted into regulations. The Regulation goes into a random pile of incomprehensible and complexe requirements. On the contrary, the operators would need a law that fixed in advance and clearly a few strong lines of conduct. So it is a weak and shoddy law which the banking and financial regulators are building for the future. It will be severe only because it will be weak and  poorly done. The lawyer will be be as chagrined as the financier is.
