► Summary: The authors, both lawyers, point out that the procedural framework of the CJIP during preliminary investigation is insufficient with regard to the rights of the defence: the legal person has no guaranteed access to the file and the fate of information disclosed before the agreement remains uncertain if negotiations fail. They propose regulating the phase preceding the offer of an agreement in order to make the CJIP more attractive.
